Claim regarding damaged cargo
The document shall be submitted to the carrier when the cargo or its part is damaged in the course of international carriage.
According to the clarifications of the Supreme Court of Lithuania, the cargo is acknowledged as damaged when the characteristics and physical state (qualitative criterion) of the goods worsen resulting in reduced value of the goods, but not in decreased quantity, weight or volume of the goods. The damage may be external (external defects are stated, for example, indentations, rust) and internal (caused by external factors during transportation, for example, air temperature when food products are carried. If the cargo or its part is damaged in the course of carriage, there is the ground to demand compensation for the losses incurred thereof from the carrier.
